A former Stockport landlady pleaded guilty to failing to dispose of commercial waste legally and was
sentenced at Stockport Magistrates on Wednesday 9th January.
Jacqueline Gallagher, aged 49, a former landlady of the Hope Inn Tavern on Wellington Road North, Heaton Norris pleaded guilty to the offence of failing in her Duty of Care contrary to Section 34 Environmental Protection Act 1990.
Ms Gallagher was fined £100, ordered to pay costs of £326.44 and a £15 victim surcharge.
The successful legal action was brought against Ms Gallagher by the Council relating to an offence on 14th May 2012. Council officers attended the car park of the pub following a report that commercial waste had been left there.
Ms Gallagher was given an information leaflet outlining what was required of the business to dispose of commercial waste legally. A formal notice was then served on Ms Gallagher to produce details of her waste collection arrangements. No details were received and a fixed penalty notice was served.
Despite two further warnings the fixed penalty notice remained unpaid resulting in the legal action.
Councillor Kevin Hogg, Stockport Council’s Executive Member for Public Realm, said: “This case should serve as a clear warning to those people who look to dispose of commercial waste illegally. This type of behavior will not be accepted in Stockport.”
