The Safer Neighbourhoods Services at Stockport Homes Group have successfully secured a possession order of a property in Brinnington, following the tenant continuously breaching their tenancy agreement with the housing provider.
Since May 2022 Stockport Homes received reports of persistent antisocial behaviour and noise nuisance emanating from the property; specifically continuous dog barking, dog fouling in the communal areas and loud music and shouting. The tenant resided in a property where dogs were not permitted and had not been granted permission for homing dogs.
Despite efforts to resolve the issues informally the tenant refused to engage or adhere to their tenancy agreement.
Working closely with the Neighbourhood Housing Officer, the Safer Neighbourhoods Service was able to gather sufficient evidence to take legal action against the property and its tenant. The Safer Neighbourhood Team secured a 12-month civil injunction against the tenant in October 2023, however despite taking this action to resolve the issues the behaviour continued.
The Possession Order was granted at a hearing at Stockport Magistrates’ Court in June 2024 and came following all other legal remedies being considered and used. The Possession Order was appealed on two occasions however both were dismissed at further hearings. The warrant for possession of the property was executed on 22nd January 2025 with local officers from the Brinnington Policing Team attending.
Possession of a property is always the last resort after all other options have been exhausted. Seeking possession of a property can take years due to the legal process however securing possession of this property will provide respite and protection for the residents who were affected by the behaviour, this type of action will reassure residents and the local community, that anti-social behaviour and crime will not be tolerated, and action will be taken against those who participate in this.
Anne-Marie Heil Director of Customer Services at Stockport Homes said:
“Every resident has a right to feel safe and secure in their home, and we are dedicated to ensuring that this is the case.
